It is contended by' counsel for the defendant that the court erred in giving instruction No. 3, which is 'as follows': “Before you can find for the plaintiff in this case, you must find from a preponderance of the evidence that A. W. 'Shirey employed plaintiff to obtain possession of certain letters belonging to him which one Madame Rupert had in her possession, and that said letters were not to be used or suppressed as evidence by the said A.
