*1359Appeal from a judgment of the Erie County Court (Michael L. D’Amico, J.), rendered September 7, 2012. The judgment convicted defendant, upon a jury verdict, of aggravated unlicensed operation of a motor vehicle in the first degree and failure to stay within a single lane.

It is hereby ordered that the judgment so appealed from is unanimously affirmed.
