| .¿This is an appeal from a judgment of the trial court sustaining defendant’s exceptions of no right and no cause of action. For the reasons stated herein, we affirm. Facts

Plaintiff, Joseph Laguerre, filed the instant petition for damages alleging he was involved in an automobile accident with a hit and run driver on January 3, 2007. Plaintiff alleges that he subsequently discovered that the vehicle involved in the accident was owned by Alfredo Mendez and that plaintiff located this vehicle near the accident scene.
