SIMONETT, Justice.

Defendant was charged by a grand jury in Hennepin County with two counts of second-degree murder, one alleging that he intentionally killed the victim, the other alleging that the killing occurred in the course of defendant’s committing felonious assault. Minn.Stat. § 609.19 (1982). The trial court granted a defense motion for judgment of acquittal of the first charge at the conclusion of all the evidence.
