This is a 'motion by the defendants, other than Frank Loggia, to dismiss the complaint for insufficiency on its face.
Defendant Loggia applied to the plaintiff bank on behalf of the Hamilton Ridge Corporation for an F.H.A. loan. Believing that Loggia was, as he represented himself to be, the president of the corporation, plaintiff gave Loggia cashier’s checks made to the corporation as payee amounting to $2,500, and received in return a promissory note in the amount of $2,874.50, *526to which Loggia signed the corporation’s name.
