Plaintiff filed petition in three counts to recover a $1000 with interest on each count. The cause had its origin in the issue of three cashier's checks issued by plaintiff and paid by it to defendant. At the close of plaintiff's case the court gave a peremptory instruction, directing the jury to find for the defendant. Thereupon, plaintiff took an involuntary nonsuit with leave to move to set aside. Motion to set aside was timely filed, but overruled and plaintiff appealed.
