MEMORANDUM ON MOTIONS FOR SUMMARY JUDGMENT

The court has before it the Motion for Summary Judgment filed by the Plaintiff on June 28, 2001, and the Defendant’s Motion for Summary Judgment filed by the Defendant on July 18, 2001. At issue in this adversary proceeding are a Note and Deed of Trust executed by the Debtors on August 27, 1998, in favor of The Money Centre, Inc.
