At the March term, 1866, of the Morgan Circuit Court, Stephen Sutton, as administrator of the estate of Jacob Emericlc, deceased, obtained a judgment by default, after due service of process, against Christopher Shaffer, for money alleged to have been received -by Shaffer, belonging to Emerick’s estate, for $1,100. An execution was duly issued on this judgment, and was in the hands of James Dick, the sheriff of Oass county, to which county it was directed, and was levied upon Shaffer’s land.
