"William M. Kitt sued Henry Bunge for damages for an alleged breach of contract. Bunge filed a counterclaim for specific performance of the same contract. The court held with Bunge both on the complaint and counterclaim.

On July 14, 1927, the parties contracted to exchange Kitt’s land in Weld county, Colorado, for Bunge’s land in the Province of Alberta, Canada, and $1,000 in cash. The contract contained these provisions: “It is understood and agreed between the parties hereto, that the $1,000.00 cash payment is not to be made until October 1, 1927, at which time the transfers are to be made…
