On March 9, 1970, 397 U.S. 232, 90 S.Ct. 891, 25 L.Ed.2d 246, the Supreme Court of the United States entered an order in this cause which provided in part that “the Court of Appeals’ order of remand of December 19, 1969, be, and the same is hereby, affirmed with directions that the District Court proceed promptly to consider the issues before it and to decide the case consistently with Alexander v.
