OPINION AND ORDER

DOUMAR, District Judge.

Presently before the Court is Defendant’s Motion to Dismiss. For the reasons set forth herein, the Court denies Plaintiffs request for a hearing and GRANTS Defendant’s Motion to Dismiss.

I. Factual and Procedural Background

Plaintiff Chris Contreras (“Plaintiff’) filed suit against Defendant Thor Norfolk Hotel, LLC (“Defendant”) in the Circuit Court for the City of Norfolk on or about May 19, 2003, and served Defendant on May 27, 2003.
