This case is before the court on appeal from the order of Bankruptcy Judge Duncan W. Keir, denying the motion of Appellant Videsh Sanchar Nigam Limited (“VSNL”) to dismiss or, in the alternative, to compel arbitration of Plaintiffs claims. Oral argument is deemed unnecessary because the facts and legal arguments are adequately presented in the briefs and record, and the decisional process would not be significantly aided by oral argument.
