The defendants, Travis Turner and Jerry Attebery, have appealed from the judgment of the Superior Court of Merced County in a wrongful death action in which the jury’s verdict was in favor of the plaintiffs and against both defendants.
The action arose out of an automobile accident occurring just north of Merced on Highway 99 on the night of August 21, 1958. Defendants testified that they had met at a drive-in in Merced and agreed to test their automobiles in a “drag race.” Defendant Attebery was driving a 1956 Ford automobile and was accompanied by one Scott, who testified at the trial.…
