This case is before us for the second time, following our certification to the Vermont Supreme Court of three questions regarding Vermont workers’ compensation law. See Travelers Ins. Co. v. Carpenter, 313 F.3d 97, 109 (2d Cir.2002) (“Travelers I”). By order dated August 31, 2004, the Vermont Supreme Court dismissed the certified proceeding, holding that its earlier acceptance was improvidently granted. Travelers Ins. Co. v.
