This is an appeal by the defendant from a judgment on a verdict for $4,000 in an action for damages in an automobile accident case.

The defendant, with his mother and sister, all residents of San Francisco, made a trip to Montreal by automobile in 1929. When they started on their homeward journey, the plaintiff, a second cousin of the defendant, joined the party as a guest. The defendant’s sister stopped at Lincoln, Nebraska, and the remaining three proceeded on their way toward San Francisco, their destination.
