The plaintiff in error was by information jointly charged with L. C. Privett with the larceny of five fresnoes, of the value of $137.50; was tried separately, convicted, motion for new trial filed, considered, overruled, and the record properly saved. The plaintiff in error, who will hereinafter be referred to' as the defendant, was sentenced to serve three years in the state penitentiary.

James.R. Banner, testifying for the state, stated:
