-At the time in question, deceased was in the employ of defendant, working between the town of Barney and the town of Borimor, some five miles distant, on the right of way of the Chicago Great Western Railway Company, engaged in the construction or repair of a telegraph line belonging to the defendant company. The crew had been working out of Borimor. The accident occurred about a mile southwest of Barney.
