This is a case to set aside and cancel a conveyance of 80 acres of land in Saline county on the ground that it was fraudulently obtained. The plaintiff and defendant are husband and wife. The plaintiff is a man 68 years of age. In 1865 he entered 160 acres of land in Saline county under the United States homestead law, of which tract the 80 acres in controversy form a part. In 1882 plaintiff, *249wlio was a widower with one son, lived upon his homestead, and the defendant Anna Bingaman at that time was living on her farm near-by.
