This is an appeal from the district court of. Okmulgee county, involving the probate of the last will and testament of James H. Puckett, deceased.

The facts are substantially as follows : The deceased, at the time of his death, had been a resident of Okmulgee county, Okla., for several years, and in said county, on or about the 29th day of July, 1916, the deceased executed a will, devising and bequeathing the major part of his estate to W.
