Plaintiff, Dr. John N. Swartz, since 1917 has been the owner of certain lands in the township of Waterford, county of Oakland, located in the northwest fractional quarter of section 30, township 3 north of range 9 east. These lands were subdivided and platted as Swartz’s Pleasant Lake Highlands, the plat being recorded in 1925. They lie mainly on the westerly and southerly sides of Pleasant lake, which is an inland lake covering approximately 90 acres of land without an inlet or outlet.
