HANING, J.

Plaintiff/appellant First Interstate Bank appeals a judgment in favor of defendants/respondents State of California and the Board of Governors of the California Community Colleges (Board) after the trial court sustained without leave to amend respondents’ demurrer to appellant’s complaint grounded in, inter alia, breach of contract and negligence. Appellant contends the trial court erred in its basic conclusion that respondents are not liable as a matter of law for the acts of a particular community college district.
