Hunt was a yardmaster in the service of the ..defendant company at Cordele. On July 10, 1910, which was ¡Snip-; day, he received instructions to switch, certain ears, containing *274perishable freight, in order that their forwarding might be expedited. In order to place these cars, what is known as a “hying switch” was made. Hunt was on the foot-board of the engine, for the purpose of unloosing the freight-cars from the engine, in order that they might take one track while the engine took the other.
