OPINION AND ORDER
GERSHON, District Judge.
Plaintiff, Craig Kaplan, a resident of New Jersey, commenced this action on July 26, 2002, seeking monetary damages in the amount of $509,000 against defendants Aspen Knolls Corp. and its principal, Robert Mazzuoccola, each a resident of New York. Plaintiff brings claims for breach of contract, equitable violations and violations of New York State Labor Law §§ 198 et seq.
