FOSTER, Circuit Judge.

Defendant in error, plaintiff'below, filed his suit, against the plaintiff in error, defendant below, to recover $77,625, on a cause of action that is best shown by a brief statement of the pleadings. The parties will hereafter be referred to as they appeared in the District Court.
