Defendant, the City and County of Denver, appeals from an order denying its motion to dismiss the complaint for declaratory relief filed by plaintiff, Wendy R. Matthews. We affirm.

Plaintiff was injured in an automobile accident with a City-owned vehicle. The vehicle was operated by one of the City's employees during the course and seope of his employment. Plaintiff brought this declaratory judgment action to determine whether the notice of claim she filed with the City was timely under the Colorado Governmental Immunity Act (GIA), § 24-10-101, et seq., C.R.9$.2000.
