OPINION

{¶ 1} Appellant, David P. Slocum, appeals from the October 19, 2007 judgment entry of the Ashtabula County Court of Common Pleas, in which he was sentenced for operating a vehicle under the influence of alcohol ("OVI").

{¶ 2} On October 27, 2006, appellant was indicted by the Ashtabula County Grand Jury on one count of OVI, a felony of the third degree, in violation of R.C. 4511.19(A)(1) and (C)(1). Appellant pleaded not guilty at his arraignment on November 3, 2006.
