James Sumpter (“Sumpter”) appeals from an order entered by Hon. Robert D. Drain of the United States Bankruptcy Court for the Southern District of New York (“Bankruptcy Court”) in In re DPH Holdings Corp. et al., No. 05-44481. The order denied Sumpter’s “Amended Motion for Recoupment On Behalf of Delphi Salaried Retirees” (“Amended Recoupment Motion”).
