Affirming.

The town of Wallins enacted an ordinance in May, 1921, providing-for the improvement by grading and paving with reinforced concrete, water bound macadam, Kentucky rock asphalt or other bituminous types of construction equally as good, of certain streets in the town. Howard street, Railroad avenue, Bridge street and Cumberland street were mentioned as the streets to be improved. An ordinance provided that the improvements should be constructed in accordance with plans- and specifications for such type of construction adopted by the state highway…
