Duprey v. Eagle Lake Water & Sewer District
Supreme Judicial Court of Maine
1Opinion of the Court
RUDMAN, Justice.
Lewellyn Duprey (“Duprey”) appeals from a judgment entered in the Superior Court (Aroostook County, Pierson, J.) concluding that the Eagle Lake Water & Sewer District (“Eagle Lake”) may conduct a foreclosure sale of property on which it held a sewer lien. On appeal, Duprey contends that the Superior Court erred in finding that the 18 month period of redemption set by state law 1 concerning Eagle Lake’s mortgage was not tolled by the automatic stay provision of section 362(a) of the United States Bankruptcy Code. 2 We modify the judgment and as modified affirm.
