DELEHANT, District Judge.

In this proceeding under Section 75 of the Bankruptcy Act, 11 U.S.C.A. § 203, by a memorandum filed October 15, 1942, the court endeavored to set out the reasons which prompted it to overrule, as of that date, a motion by the secured creditor for dismissal of debtor’s amended petition and for the vacation of the order of adjudication and reference theretofore made and given thereon.
