SANBORN, Circuit Judge.

The assistant United States attorney for the Western district of Oklahoma on the ,30th day of April, 1925, filed in the court below an information against Henry Turk in two counts, in the first of which he gave the court “to understand and be informed that heretofore, to wit, on or about the 25th day of May, 1924, in Oklahoma county in the Western district of the state of Oklahoma and within the jurisdiction of this court, Henry Turk, * * 11 then and there being, did then and there knowing-ly, willfully and unlawfully have in his possession and under his control…
