Tbe plaintiff is, and has been for about twenty years, the owner of a tract of land in Hamblen county, through which the defendant’s road was erected before his purchase. There is a valley running north and south in which the land is situated. About one and a half miles south of the farm is a spring, from which Riggs’ branch runs about one-fourth of a mile northward into a sink, and disappears in ordinary time of water.
