Appeal by the defendant (1) from a judgment of the Supreme Court, Kings County (Starkey, J.), rendered June 23, 1992, convicting him of robbery in the third degree, attempted robbery in the third degree, and criminal possession of a weapon in the fourth degree, upon a jury verdict, and imposing sentence, and (2) by permission, from an order of the same court dated February 22, 1994, which denied his motion pursuant to CPL 440.10 to vacate the judgment rendered June 23, 1992.

Ordered that the judgment and the order are affirmed.
