Hello, everyone. This is OmniTalk Retail. I'm Chris Walton, and you are listening to the Retail Daily Minute, your quickest, fastest breakdown of all the day's top retail news. Today's podcast is brought to you once again with the help and support of R&S Logistics. Are you looking for a fulfillment and distribution partner? That's just right. Well, RNS Logistics is small enough to provide custom solutions and that personal touch, while also still boasting 2 million square feet across 10 locations in the Southeast. With technology that can scale your growing e-commerce operations, visit rswarehousingsolutions.com and get your quote today. And I'm also pleased to introduce Zenline AI because you have likely heard about AI agents a thousand times this year. They're also probably wondering what they can do for you as a retailer. Visit tryzenline.ai to book a call and see how agents can bring you more margin. This morning, we've got news on Amazon striking a new shopping partnership with YouTube and Hope Depot rolling out its AI assistant into the aisles. But we begin today with a case that could get very ugly, very ugly for Amazon's ad business, the FTC. joined by 22 state attorneys general has sued Amazon alleging the company secretly inflated its search ad auction prices for more than seven years. Whenever the phrase state attorneys general is uttered, you know it's not the best of news. Here's how the mechanism in question supposedly worked. In Amazon's second price auctions, advertisers are supposed to pay one cent more than the next highest bid. But according to the complaint, Amazon quietly added what internal documents called a, quote, hidden surcharge back in 2019, a so-called, quote, soft reserve price, end quote, that pushed advertisers to pay substantially more than the auction itself would dictate. And the FTC says Amazon leaned harder on that lever during high volume windows like Prime Day and Black Friday, ramping up prices gradually so no one would notice the hike. The numbers here are not small either. We're talking north of a million brands affected, tens of billions in extra revenue on an ad business that pulled in nearly $70 billion, $70 billion last year, and controls roughly three quarters of the entire retail media market. Amazon, for its part, is pushing back hard, pointing to flat inflation adjusted cost per click and a 24 percent rise in conversion rates and waving off the internal emails as brainstorming, not policy. Now, to be clear, these are allegations, not a verdict. And Amazon's rebuttal is coming straight from its own blog. So take both sides with the grain of salt they deserve. But here's my honest read. Even if Amazon wins on the legal technicalities, the real question is whether advertisers had any real say in the matter. And as e-marketer Zach Stamber points out, Amazon is nearly impossible to walk away from. When you control that much of the market, buyer beware stops being a warning and starts being a business model. Of course, then again, that is also why governments exist. To prevent an uneven distribution of power, or at least historically, that is how our government functioned.
