Tbe plaintiff, John N. Bussell, administrator of the estate of J. N. Bussell, deceased, brought an action in the superior court of Cincinnati against the Fourth National Bank for equitable relief. The elder Bussell in 1865 became the owner of thirty shares of the capital stock of the defendant bank. Dividends were paid to him semi-annually in May and November during that year and the year following, and never afterwards.
