MEMORANDUM OPINION ON MOTION TO DISMISS COMPLAINT AND MOTION FOR SUMMARY JUDGMENT

Before the court are two motions concerning the debtors’ complaint for declaratory relief under 11 U.S.C. § 510(b). The defendants, Janet Baker and James Baker, seek to dismiss the debtors’ complaint. The debtors cross-move for summary judgment.
