— Appeal from a judgment of the Supreme Court at Special Term, entered April 17, 1978 in Albany County, which granted in part petitioner’s application, in a proceeding pursuant to CPLR article 78, and directed that a new parole hearing be held before April 30, 1978. On August 13, 1976, petitioner was sentenced to an indeterminate term of imprisonment with a maximum of life and a minimum of one year following his conviction of the crime of the sale of controlled substances in the third degree.
