This is a suit on a policy of insurance issued by defendant to plaintiff on a two-story brick building in the town of Higbee in this State, claimed to be owned by plaintiff. Tbe defense set up is that plaintiff was not the sole owner of tbe property at tbe time of tbe application for and of tbe issuance of tbe policy, as alleged by him. In tbe trial court plaintiff obtained judgment for $2,000, and defendant appealed tbe case to the Kansas City Court of Appeals.
