OPINION

STERN, District Judge.

This is an action brought under the Administrative Procedure Act, 5 U.S.C. §§ 701 et seq. to set aside an order of the Environmental Protection Agency. That order required that a grantee under Title II of the Federal Water Pollution Control Act (FWPCA), 33 U.S.C. §§ 1281 (Supp.1977) et seq., readvertise bids on a contract to construct part of a secondary waste water treatment facility.
