1Per curiam
The plaintiff in error was convicted of grand larceny in the district court of Roger Mills county. A motion for new trial was duly filed, and on September 7, 1916, the court overruled the motion and rendered judgment on the verdict and sentenced the plaintiff in error to 'be confined in the penitentiary at McAles-ter for the term of 2y2 years. From the judgment an appeal was attempted to he taken by filing in this court on March 6, 1917, a petition in error. On September 24, 1918, this attempted appeal was discussed. Clark v. State, 15 Okla. Cr. 53, 174 Pac. 1093.
