PIOOD, Judge.

This is a suit on a promissory note executed by defendant, Mrs. Lela Tracy Co-burn, on July 22, 1960, and secured by an act of mortgage bearing the same date and affecting real property owned by defendant. The defendant answered denying liability on the ground of failure of consideration, and she further reconvened for judgment ordering plaintiff to surrender the note for cancellation of the mortgage and condemning plaintiff to pay damages for breach of contract.
