This is an action in quo warranto, and was tried in equity. In brief, tbe plaintiff and tbe intervenerappellee allege and claim that the defendant does not have a valid and legal franchise to maintain and operMe an electric light plant and distribution systern within the corporate town of Mapleton, and js illegally occupying and using the streets and alleys of said town by maintaining poles, wires, and other equipment therein.
