DECISION AND ORDER

INTRODUCTION

Petitioner, Danny Clark (“Clark” or “petitioner”), filed this pro se petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254 challenging his conviction in Monroe County Court after a jury trial on charges of robbery in the first and second degrees (NY. Penal Law § 160.15(4); § 160.10(1)) and kidnaping in the second degree (N.Y. Penal Law § 135.20). The parties have consented to disposition of this matter by the undersigned pursuant to 28 U.S.C. § 636(c).
