*1004In an action, inter alia, to recover damages for medical malpractice, the plaintiffs appeal from an order of the Supreme Court, Kings County (Dabiri, J.), dated November 10, 2008, which granted the motion of the defendant St. Mary’s Hospital of Brooklyn for summary judgment dismissing the complaint insofar as asserted against it.
Ordered that the order is reversed, on the law, with costs, and the motion of the defendant St. Mary’s Hospital of Brooklyn for summary judgment dismissing the complaint insofar as asserted against it is denied.
