Defendant was charged with the crime of murder in Noble county; was tried, convicted and sentenced to the penitentiary for life, and has appealed.

Defendant was charged with the crime of murdering Carl Swart, his son-in-law, in Perry, Noble county, on the 25th day of June, 1937. The defendant and his wife resided at 725 Grove Street, in the city of Perry. The killing occurred in the street just in front of defendant’s home. The facts, as shown by the record, revealed that deceased had married the daughter of defendant about eight years prior to the time of the homicide. That he and his wife…
