The court below discharged a rule for judgment for want of a *199sufficient affidavit of defense, and the plaintiff appeals. The city filed a municipal claim against the property of the plaintiff situate at the southeast corner of Salem and Belvedere avenues, in the city of York; said claim being for the construction of a brick sidewalk in front of the said property, upon both streets.
