Appellant was convicted of murder in the district court of Collin county, and his punishment fixed at death. That Hardy Mills was murdered in Collin county on Friday, September 2, 1921, is be- ( yond dispute. Wbo killed him? .The state asserted that appellant did. it. The jury have so found from the facts submitted to them. Mills, with his wife and children, lived on appellant’s farm about 3% miles northwest of McKinney. He worked in town and walked to his work.
