Commonwealth v. Brown
Massachusetts Appeals Court
1Opinion of the CourtDuffly, J.
A Superior Court jury found the defendant guilty of aggravated rape (with kidnapping as the aggravating circumstance), in violation of G. L. c. 265, § 22(a); and of kidnapping, in violation of G. L. c. 265, § 26. The jury returned verdicts of not guilty on six other indictments.1 The trial judge *238directed a verdict in favor of the defendant on the kidnapping conviction.2 On appeal, the defendant claims the evidence was insufficient to support his conviction of aggravated rape, and that it was error to deny his motion for a required finding of not guilty. We affirm the judgment.
