OPINION

Mowbray, J.:
William Burns picked the pocket of John Loter while the two were in a cabaret in Fallon, Nevada. Burns obtained approximately $120. He was charged with grand larceny, tried to a jury, and found guilty. Thereafter, in a separate hearing before the district judge, Burns was adjudged to be a habitual criminal because he had been convicted of two prior felonies. NRS 207.010, subsection l.
