Appeal from circuit court, Albany county. Action by David Forsyth against James McKinney and Edward McKinney for breach of contract. Defendants appeal from a judgment entered on a verdict for plaintiff, and from an order denying defendants’ motion for a new trial.

This action is brought to recover damages for breach of an alleged contract between the parties. The plaintiff claims that by that *562contract he agreed to work for defendants for one year from the 19th day of September, 1885, at the rate of $2.75 per day; that under this contract he proceeded to work till the 30th day of October in that year, when he was wrongfully discharged by defendants.
